Please read these Terms of Service carefully before using Axion Wild. By creating an account or using the service, you agree to be bound by these terms. If you do not agree, you must not use the service.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and One Axion ("we", "us", "our"), the operator of the Axion Wild application and associated services (collectively, the "Service").

By accessing or using the Service — including registering for an account, making a purchase, or simply browsing the app — you confirm that you have read, understood, and agree to these Terms in full. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The Service

Axion Wild is a foraging discovery platform that allows users to log, share, and explore wild food finds via an interactive map, receive AI-generated recipe suggestions, and connect with a community of foragers.

We reserve the right to modify, enhance, reduce, or discontinue any aspect of the Service at any time, with or without notice, at our sole discretion. We may introduce new features that are subject to additional terms.

3. Accounts and Eligibility

3.1 Age Requirement

You must be at least 13 years of age to create an account and use the Service. Users aged 13–17 must have the permission of a parent or guardian. By creating an account, you confirm that you meet this requirement.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access at support@oneaxion.com. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

3.3 Accurate Information

You agree to provide accurate and up-to-date information when registering and to keep your account details current. Accounts created with false information may be suspended or terminated without notice.

3.4 One Account Per User

Each individual may maintain only one active account. Creating duplicate accounts to circumvent restrictions, suspensions, or limits is prohibited.

4. Subscriptions and Payments

4.1 Subscription Plans

Axion Wild offers free and paid subscription tiers. Paid plans ("Premium", "Day Pass", or as otherwise named) grant access to enhanced features as described on our pricing page at the time of purchase.

4.2 Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). By providing payment details, you authorise One Axion and our payment processor (Stripe) to charge your payment method on the applicable recurring schedule until you cancel.

4.3 Day Passes

Day passes grant access to premium features for a fixed period of 24 hours from activation. Day passes are single-use, non-transferable, and expire at the end of the 24-hour period regardless of usage.

4.4 Payment Processing

All payments are processed securely by Stripe. We do not store your full card details. By making a purchase, you also agree to Stripe's terms of service.

4.5 Failed Payments

If a payment fails, we will attempt to re-charge using any retry logic provided by our payment processor. Access to premium features may be suspended until payment is successfully collected. We are not liable for any loss of access or data resulting from payment failure.

5. Pricing and Price Changes

5.1 Right to Adjust Pricing

We reserve the right to change the price of any subscription plan or feature at any time. This includes, without limitation, increases in line with inflation indices, market conditions, increased operating costs, or our business requirements.

5.2 Annual Price Review

Subscription prices may be reviewed and adjusted on an annual basis. Price increases may be applied by reference to the Consumer Price Index (CPI) or Retail Price Index (RPI) as published by the relevant national statistics authority, plus an additional percentage at our discretion, or by a fixed amount, whichever we determine appropriate at the time of review.

5.3 Notice of Price Changes

We will provide you with at least 30 days' written notice of any price increase affecting your active subscription, sent to the email address associated with your account. The notice will state the new price and the date from which it takes effect.

5.4 Acceptance of New Price

Your continued use of the Service and failure to cancel your subscription before the new price takes effect constitutes your acceptance of the revised pricing. If you do not wish to pay the new price, you may cancel your subscription before the change takes effect; you will retain access until the end of your current billing period.

5.5 No Price Guarantee

Prices displayed at the time of purchase are not guaranteed for any future billing periods. Introductory or promotional pricing may be time-limited and subject to change upon expiry of any promotional period.

6. Refund Policy

Important: All purchases on Axion Wild are subject to the terms set out in this section. Please read carefully before making a purchase.

6.1 General No-Refund Policy

All purchases — including monthly subscriptions, annual subscriptions, and day passes — are final and non-refundable. By completing a purchase, you acknowledge and agree that you are not entitled to a refund except as expressly set out in this section or as required by applicable mandatory consumer protection law.

6.2 Digital Goods — Immediate Delivery

The Service constitutes a digital product that is made available to you immediately upon purchase. By proceeding with a purchase, you expressly request that access begins immediately and you acknowledge that your right of withdrawal (where applicable under EU consumer law) is waived upon commencement of service delivery.

6.3 No Refunds for Unused Periods

If you cancel a subscription, you will retain access to premium features until the end of the current paid billing period. No refund or credit will be issued for any unused portion of a subscription period, regardless of whether you use the Service during that time.

6.4 No Refunds for Day Passes

Day passes are activated immediately upon purchase and are non-refundable under any circumstances, including but not limited to: failure to use the pass, change of mind, or partial use.

6.5 Service Interruptions

We do not provide refunds or credits for service interruptions, outages, maintenance periods, or degraded service. Please refer to Section 7 (Service Availability and Interruptions) for our full position on service continuity.

6.6 Duplicate Charges

If you believe you have been charged in error or charged twice for the same transaction, please contact us at billing@oneaxion.com within 14 days of the charge. We will investigate and, where a genuine duplicate charge is confirmed, issue a correction promptly.

6.7 Mandatory Consumer Rights

Nothing in this refund policy limits or excludes any statutory rights you may have under mandatory consumer protection legislation in your jurisdiction that cannot be excluded by contract. Where such rights apply and cannot be waived, they are not affected by these Terms.

7. Service Availability and Interruptions

7.1 No Uptime Guarantee

The Service is provided on an "as is" and "as available" basis. We make no warranty, representation, or guarantee — express or implied — that the Service will be available continuously, without interruption, error-free, or fit for any particular purpose.

7.2 Planned and Unplanned Maintenance

We may take the Service offline for maintenance, updates, security patching, or infrastructure work at any time. Where practicable, we will endeavour to provide advance notice of planned maintenance, but we are under no obligation to do so.

7.3 Third-Party Dependencies

The Service depends on third-party infrastructure and services including database providers, hosting platforms, payment processors, and AI services. Interruptions or failures in any of these third-party services may result in degraded or unavailable functionality. We are not liable for outages, errors, or data loss caused by third-party service providers.

7.4 Force Majeure

We shall not be liable for any failure or delay in the performance of the Service arising from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemic, civil unrest, power failures, internet outages, cyberattacks, actions of government authorities, or failure of third-party infrastructure.

7.5 Data Loss

While we implement reasonable data backup procedures, we do not guarantee against data loss. You are responsible for maintaining your own records of any information you consider critical. We are not liable for any loss of data howsoever caused.

8. Limitation of Liability

8.1 Exclusion of Consequential Loss

To the maximum extent permitted by applicable law, One Axion, its officers, employees, agents, and affiliates shall not be liable for any:

This exclusion applies whether the claim is based in contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

8.2 Cap on Liability

To the extent that any liability cannot be excluded, our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the total amount paid by you to One Axion in the twelve (12) months immediately preceding the event giving rise to the claim, or €50, whichever is greater.

8.3 Indemnity

You agree to indemnify, defend, and hold harmless One Axion and its officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any harm caused by content you post to the Service.

9. User Content

9.1 Your Responsibility

You are solely responsible for all content you post, upload, or transmit through the Service ("User Content"), including foraging finds, photographs, notes, and any other data. You represent and warrant that you have all necessary rights to post such content and that it does not violate any applicable law or third-party rights.

9.2 Licence to Us

By posting User Content, you grant One Axion a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

9.3 Content Standards

You agree not to post content that is: false, misleading, or fraudulent; defamatory, abusive, or harassing; in violation of any third-party intellectual property rights; or otherwise unlawful. We reserve the right to remove any content at our discretion without notice.

9.4 Accuracy of Foraging Information

The foraging data and species identification information within the Service is user-generated and has not been independently verified. One Axion does not warrant the accuracy, completeness, or safety of any foraging information. See Section 11 for our full Foraging Safety Disclaimer.

10. Prohibited Uses

You agree not to use the Service to:

11. Foraging Safety Disclaimer

⚠️ Important Safety Notice

Foraging wild plants, fungi, and other organisms carries inherent risks, including the risk of misidentification, allergic reaction, poisoning, injury, and death. Never consume any wild food unless you are absolutely certain of its identification, ideally confirmed by a qualified expert.

One Axion provides Axion Wild as an informational tool only. Nothing within the Service — including species data, foraging finds, AI-generated recipes, maps, or any other content — constitutes professional foraging advice, medical advice, or a safety endorsement of any species for consumption.

We expressly disclaim all liability for any illness, injury, death, property damage, or other harm arising from foraging activities undertaken in connection with use of the Service. You forage entirely at your own risk.

Always consult authoritative field guides, local experts, or qualified mycologists before consuming any wild species.

12. Intellectual Property

All content, design, software, trademarks, and other intellectual property within the Service that is not User Content belongs to One Axion or its licensors. You may not copy, modify, distribute, sell, or sublicense any part of the Service without our express written consent.

The name "Axion Wild", "One Axion", and associated logos are trading names and marks of One Axion. Unauthorised use of these marks is prohibited.

13. Termination

13.1 By You

You may close your account at any time through the account settings in the app. Subscription cancellations take effect at the end of the current billing period; no refund is issued for the remaining period.

13.2 By Us

We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including but not limited to: breach of these Terms, non-payment, fraudulent activity, or conduct we determine to be harmful to the Service or other users.

13.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Sections 6, 7, 8, 11, and 15) will continue to apply after termination.

14. Changes to These Terms

We may update these Terms at any time. For material changes, we will provide at least 14 days' notice by email and/or in-app notification before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.

If you do not agree to revised Terms, you must stop using the Service and close your account before the changes take effect.

Non-material changes (such as clarifications, corrections, or changes required by law) may take effect immediately.

15. Governing Law and Disputes

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law principles.

15.2 Jurisdiction

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Cyprus, except where mandatory consumer protection legislation in your country of residence requires otherwise.

15.3 EU Consumer Rights

If you are a consumer resident in the European Union, you may also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15.4 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us at support@oneaxion.com to attempt to resolve any dispute informally. We will endeavour to respond within 10 business days.
